Event Safety and Participation Rules
By registering for the Rombo Marathon (the "Marathon") and/or purchasing a ticket to the Ndafu Festival (the "Festival"), collectively referred to as the "Event," you ("Participant" or "Attendee") agree to be bound by the following Terms and Conditions (the "Terms").
SECTION A:

GENERAL EVENT TERMS (APPLICABLE TO ALL)

1. Acceptance of Terms

By participating in any way in the Event, the Participant/Attendee acknowledges having read, understood, and agreed to these Terms.

2. Event Cancellation/Postponement

The organizers (Rombo Marathon & Ndafu Festival Limited) reserve the right to modify, postpone, or cancel the Event at any time due to unforeseen circumstances, including but not limited to severe weather, government restrictions, natural disaster, public health emergency, security concerns, or other Force Majeure events.

  • Refund Policy: In the event of cancellation or postponement, the Organizers’ policy on refunds, transfers, or credits will be communicated clearly. Generally, registration/ticket fees are non-refundable, and the Organizers shall not be liable for any costs incurred by the Participant/Attendee (e.g., travel, accommodation) as a result of such cancellation or postponement.

3. Image, Media, and Likeness Rights

The Participant/Attendee irrevocably grants the Organizers and their partners the right to photograph, record, and film their participation and attendance at the Event. The Participant/Attendee waives all rights to compensation and grants permission for the free use of their name, image, and likeness in any broadcast, telecast, and print media for promotional or commercial purposes related to this or future events, without time limitation.

4. Code of Conduct and Right of Removal

  • All Participants and Attendees must abide by all laws, rules, and regulations of Tanzania and the directives of the Organizers, Event Staff, Volunteers, and Security personnel.

  • The Organizers reserve the right to refuse entry or remove any person from the Event venue, without refund, for any reason, including but not limited to: violation of these Terms, disorderly conduct, failure to comply with instructions, or actions that pose a risk to themselves or others.

5. Alcohol, Drugs, and Prohibited Items

  • The consumption of illegal drugs is strictly prohibited.

  • Alcohol consumption is subject to local laws and Event licensing. Attendees must be of legal drinking age. The Organizers reserve the right to restrict or prohibit the bringing of outside alcohol.

  • Prohibited items (e.g., weapons, fireworks, glass containers, unauthorized promotional materials) will be confiscated, and the individual may be denied entry or removed from the Event.



SECTION B:

MARATHON/TRAIL RUN SPECIFIC TERMS

6. Health, Fitness, and Medical

  • Medical Disclaimer: The Participant certifies that they are physically fit and have sufficiently trained for the completion of their chosen race distance and have consulted a qualified medical doctor to assess their suitability.

  • Assumption of Risk: The Participant acknowledges and assumes all risks associated with participation in an extreme physical event, including, but not limited to, falls, contact with other participants, the effects of weather (heat, cold, altitude), traffic, the condition of the road/trail, and potential injury, illness, disability, or death.

  • Medical Consent: The Participant consents to receive and agrees to pay for any necessary medical treatment, including ambulance transport, deemed advisable by Event medical personnel. The Organizers are not responsible for any medical expenses incurred.

7. Registration, Transfers, and Refunds

  • Eligibility: Participants must meet the minimum age requirement for their registered distance as specified by the Organizers (e.g., typically 18 for a full marathon, 16-17 for a half marathon, with parental consent for minors in shorter distances).

  • Non-Transferable/Non-Refundable: Confirmed registrations are non-refundable, non-transferable to another person, and cannot be deferred to a future year, except as specifically provided in these Terms.

  • Bib/Timing Device: Race bibs and timing devices are non-transferable and must be worn as instructed. Wearing another person’s bib will result in disqualification for both parties.

8. Race Rules and Disqualification

  • The Participant agrees to abide by all official race rules, including start times, course directions, cut-off times, and equipment requirements.

  • The Race Director’s decision on all matters, including disqualification, is final. Grounds for disqualification include, but are not limited to:

    • Failure to complete the entire course.

    • Receiving unauthorized outside assistance.

    • Disorderly conduct or unsportsmanlike behavior.

    • Failure to adhere to cut-off times.

9. Environmental and Trail Etiquette

  • The Rombo Marathon course includes a scenic forest trail. Participants must respect the environment and local community.

  • No Littering: Participants must not litter and must carry out all personal trash. Anyone observed littering will be immediately disqualified.


SECTION C:

NDAFU FESTIVAL-SPECIFIC TERMS

10. Admission and Ticketing

  • A valid ticket or accreditation is required for entry to the festival grounds.

  • The organizers are not responsible for lost, stolen, or damaged tickets.

  • Tickets may not be re-sold for a profit, and unauthorized re-sale may result in voiding the ticket without refund.

11. Security and Search

All Attendees, bags, and vehicles are subject to search upon entry and at any time while on the Festival grounds. This is a condition of entry.

12. Noise and Disruptions

The Festival will involve music and high noise levels. Attendees acknowledge this and assume any risks associated with exposure to loud music, including hearing damage.


 

SECTION D:

WAIVER, RELEASE OF LIABILITY, AND INDEMNIFICATION

13. Release and Waiver of Claims

In consideration of being permitted to register and participate in the Event, the Participant/Attendee, for themselves, their heirs, executors, and administrators, waives, releases, and discharges the Organizers, sponsors, promoters, property owners, local authorities, agents, employees, volunteers, and all other associated entities (“Releasees”) from any and all claims, liabilities, demands, damages, and causes of action whatsoever arising out of or related to any loss, damage, injury, illness, disability, or death, that may be sustained by the Participant/Attendee, or any property belonging to the Participant/Attendee, while participating in the Event, even if caused by the ordinary negligence of the Releasees.

14. Indemnification

The Participant/Attendee agrees to indemnify and hold harmless the Releasees from any loss, liability, damage, or costs, including attorney’s fees, they may incur due to the Participant/Attendee’s participation in the Event, whether caused by the Releasee’s ordinary negligence or otherwise.
